Terms for use of maxameter.com and the Maxameter service

1. General
These terms of use ("Terms") govern your use of the website maxameter.com ("Website") and the SaaS service Maxameter ("Service"), provided by Gårdefelt Systems AB, reg. no. [ORG.NR], Ranhammarsvägen 5, 168 67 Bromma, Sweden ("we", "us", "Company").
By using the Website or the Service you accept these Terms. If you do not accept the Terms, you must not use the Website or the Service.
2. The Website
2.1 Use
The website maxameter.com provides information about Maxameter, its products and services. The content is intended for informational purposes and is primarily aimed at companies and organisations in Sweden.
2.2 Intellectual property
All content on the Website – including text, images, graphics, logos, videos, software and design – belongs to Gårdefelt Systems AB or its licensors and is protected by copyright and other intellectual property rights. You may not copy, distribute, modify or otherwise use the content without our written consent.
2.3 Trademarks
"Maxameter" and the Maxameter logotype are trademarks belonging to Gårdefelt Systems AB. Use without permission is prohibited.
3. The Service (SaaS)
3.1 Access and licence
The Maxameter Service is provided as Software-as-a-Service (SaaS). Upon entering into a customer agreement you receive a non-exclusive, non-transferable right to use the Service for the duration of the agreement. The Service may not be sub-licensed, copied or decompiled.
3.2 Customer data
You own your data. All business data you store in the Service belongs to you. We process your data solely for the purpose of providing the Service and in accordance with our data processing agreement. Upon termination of the agreement you have the right to export your data in standard format.
3.3 Availability
We strive for high availability but do not guarantee uninterrupted access. Planned maintenance is notified in advance. We are not responsible for interruptions caused by circumstances beyond our control (force majeure), including internet issues, power outages or third-party providers.
3.4 Account and security
You are responsible for keeping your login credentials secure and confidential. You are responsible for all activity that occurs via your account. Notify us immediately if you suspect unauthorised access.
3.5 Acceptable use
The Service must not be used for:
- Illegal activities or activities contrary to Swedish law
- Storing data that infringes third-party rights
- Attempting to gain unauthorised access to the Service, other customers' data or our infrastructure
- Activities that could damage, overload or degrade the performance of the Service
4. Pricing and payment
Prices for the Service are set out in the current price list at maxameter.com/en/priser and the individual customer agreement. All prices are exclusive of VAT unless otherwise stated. Payment terms are specified in the customer agreement. We reserve the right to adjust prices with 3 months' notice.
5. Term and termination
5.1 Term
Customer agreements run until further notice with the notice period stated in the individual agreement, unless otherwise agreed.
5.2 Termination
Termination must be made in writing by email to [email protected]. Upon termination you have the right to export your data within 30 days after the agreement ends.
5.3 Immediate termination
We reserve the right to immediately suspend or terminate access in the event of material breach, non-payment (after notice) or use in violation of these Terms.
6. Limitation of liability
The Service is provided "as is". We do not warrant that the Service is error-free or meets all of your specific needs. Our total liability is limited to the amount you have paid for the Service during the preceding 12 months. We are not liable for indirect damages, loss of profit, data loss or consequential damages.
7. Changes
7.1 Changes to the Terms
We may update these Terms from time to time. For material changes we will notify customers at least 30 days in advance by email. Continued use after the change takes effect constitutes acceptance of the updated Terms.
7.2 Changes to the Service
We continuously develop and improve the Service. We reserve the right to add, change or remove features. We will notify you in advance of material changes that affect your use.
8. Governing law and disputes
These Terms are governed by Swedish law. Disputes arising in connection with these Terms shall in the first instance be resolved through negotiation. If the parties cannot agree, the dispute shall be settled by a Swedish general court with the Stockholm District Court as the court of first instance.
